Legal Worship
U.S. law protects sincerely held religious beliefs, meaning the use of psilocybin mushrooms in worship can be safeguarded as long as certain criteria are met.
SSM was founded through spiritual communion facilitated by psilocybin mushrooms.
Legal Worship and the Mushroom Sacrament
At Sacred Sacraments Ministry, we consider psilocybin mushrooms an essential sacrament that enables us to connect directly with the Divine. Our belief is that using this sacrament is not only a spiritual practice but also a legally protected expression of our deeply held religious faith.
Legal Protections for Sincerely Held Religious Beliefs
U.S. law protects sincerely held religious beliefs, meaning the use of psilocybin mushrooms in worship can be safeguarded as long as certain criteria are met. The use of the mushroom sacrament must meet two key requirements:
- Safety: The practice must be conducted in a way that is responsible and safe.
- Centrality: The mushroom sacrament must play a vital role in your religious practice.
However, there is no clear-cut test for what constitutes “centrality.” Courts will evaluate evidence to determine if the use of mushrooms is a legitimate part of religious worship or if someone is merely using religious claims to avoid drug laws.
The U.S. Supreme Court clarified these standards in the case of UDV v. U.S., which involved the religious use of ayahuasca. The Court ruled in favor of the religious group, affirming that their use of the sacrament was protected under the Religious Freedom Restoration Act (RFRA) because it was both safe and central to their faith. The Court emphasized that the group’s religious practices were genuine, not a guise for circumventing drug laws. These principles were further reinforced by a lower court in the Santo Daime case, which is also highly instructive.
What Does It Mean for Mushrooms to Be “Central” to Your Faith?
The idea of “centrality” means that mushrooms must be indispensable to your religious practice. If mushrooms are central, it would be impossible to practice your faith without them. This principle must be demonstrated both at the organizational level and for individual practitioners who may face legal scrutiny.
For SSM, the organization itself was founded through spiritual communion facilitated by psilocybin mushrooms. These ceremonies revealed that the mushrooms serve as a conduit to the Divine and act as an essential organizational structure that supports individual growth and spiritual development. Without this sacrament, the foundation of SSM’s mission would not exist. Thus, SSM satisfies the requirement of “centrality” at the institutional level.
For an individual member, however, if you face legal challenges, you would likely need to demonstrate that mushrooms are indeed central to your own personal faith and spiritual practice. This means showing that your religious beliefs are sincere, that you are not using religion as a loophole to avoid drug laws, and that psilocybin mushrooms play a key role in your worship.
To substantiate this, and to genuinely benefit from the sacrament, members are encouraged to create and regularly update a personal covenant with the Divine, reflecting their spiritual journey. This covenant is developed through ongoing introspection, communion with the Divine, and a commitment to personal transformation. It goes beyond occasional psilocybin ceremonies; it involves continuous work to cultivate respect for oneself, others, and the Divine. This is the true process of integrating the mushroom sacrament into your life and making it central to your faith.
Personal Covenant as Sacred Text
While you may or may not need this personal covenant in a legal context, it is crucial for your spiritual path. Documenting these insights and commitments creates your sacred texts. These writings are part of the integration process, helping you reflect on your journey and growth, both during and after ceremonial use.
Membership and Donation
For those interested, SSM offers a membership card for a donation. Although this donation and card are not definitive proof of sincerity, they may help demonstrate a genuine commitment to the practice and beliefs of the community.
Acknowledging Legal Risks and Responsibility
We are fully aware that psilocybin mushrooms are classified as a Schedule I controlled substance under U.S. law. This means that using the sacrament could potentially lead to legal consequences, including arrest and incarceration. While we believe in the legitimacy of our religious practice, we also understand the risks involved. Members must approach the sacrament with caution and responsibility. We strive to avoid provoking legal action, instead focusing on spiritual growth and healing.
To ensure safety and compliance with the law, the sacrament must only be used in ceremonial contexts, never shared with anyone under the age of 21, and should not be transported through the mail. The use of the sacrament must always prioritize safety and responsibility.
A Commitment to Open Worship
Despite the risks, SSM remains steadfast in its commitment to spiritual growth and communion. Our religion seeks to heal and enlighten, using a sacrament that we believe is as valid and effective as any other legally recognized religious practice. We are proud to stand by the efficacy of our sacrament and invite comparisons with other forms of spiritual practice that also seek divine insight and enlightenment.
